Gregory J. Pepe Presents “The Anatomy of a Prosecution” to ASMC

New Haven, Connecticut (October 7, 2014) – Attorney Gregory J. Pepe, a founding partner with the law firm of Neubert, Pepe & Monteith, P.C., will present at the American Society of Medical Association Counsel (ASMAC) conference later this month. Mr. Pepe practices in the areas of health care law, commercial finance and general business law. He advises a number of state and private medical societies regarding physician practice management issues within the context of organized medicine and managed care.

Mr. Pepe’s presentation, “The Anatomy of a Prosecution – One Doctor’s Horrific Experience When the DEA and US Attorney Came to Arrest Him” will review a current case involving a physician who prescribed opioids to his patients for pain management, and how those behaviors became exploited by criminals posing as patients, as well as by patients addicted to opioids. The ensuing events led to the physician’s arrest and indictment.

In recent months federal agents working with the DEA (Drug Enforcement Administration) and FBI (Federal Bureau of Investigation) have aggressively sought prosecution of physicians, pharmacists and individuals involved in the theft and diversion of prescription pain killers. Any doctor or dentist who prescribes pain medication or any entity which pools this type of information for doctors (for example, medical and specialty societies such as The American College of Physicians, AMA, ADA, American Board of Internal Medicine) needs to be advised of the risks. In addition, as hospitals continue to purchase the practices of, and hire more and more internists, those hospitals are vulnerable to the risks attendant to those physicians.

Prosecution is aided by more comprehensive electronic data which tracks the prescribing habits of DEA licensed prescribers, and more sophisticated software which can isolate certain prescribers and their patients. Mr. Pepe will outline the legal risks that doctors, dentists, pharmacists, hospitals, and medical societies face and how those risks can be mitigated.
