Attorneys
Contact: Douglas S. Skalka

The creditor rights and bankruptcy lawyers at Neubert, Pepe & Monteith, P.C., have extensive experience in serving the needs of individuals and businesses dealing with financial distress and insolvency issues. Drawing on the experience of our bankruptcy, finance, business law and real estate backgrounds, we are able to provide sophisticated and comprehensive of services to our clients. We have one of the largest creditor rights and bankruptcy practices in Connecticut including five attorneys each with more than ten years of experience in handling issues related to financially troubled enterprises. We regularly represent creditors, debtors, trustees, examiners, investors and purchasers in the bankruptcy and financial workout process in Connecticut, New York City, and throughout the Northeast United States. Our professionals are active in their practice areas and have served as leaders of such organizations as the Turnaround Management Association, American Bankruptcy Institute, IWIRC and the Commercial Law and Bankruptcy Section of the Connecticut Bar Association.

For creditors, we provide an analysis of their position and assist with them in structuring a strategy to achieve maximum recovery. We also have substantial experience representing creditors in litigation, financial workouts or alternative dispute resolutions.

We regularly counsel individuals, businesses and investors in economic crisis to determine the best course of action. Based upon an analysis of their individual financial situation, we determine whether a financial workout, bankruptcy reorganization or orderly sale is the proper course, reviewing all options and alternatives.

We have done extensive work on behalf of trustees and examiners appointed by the Office of the United States Trustee. Calling on the experience of our lawyers in several disciplines, we have successfully represented trustees and examiners in bankruptcy courts and other federal courts in actions involving diverse issues, from professional malpractice to contract disputes. In addition, we regularly assist these clients in consummating the sale of estate assets, preparing plans of reorganizations, dealing with employment issues, real estate and landlord/tenant concerns.

Finally, our lawyers have also often represented investors and businesses pursuing the purchase of real property, equipment or other assets from troubled companies and bankruptcy estates. This representation commences with an analysis to determine the best way to consummate the deal sought. We regularly counsel our clients regarding the benefits and risks associated with buying assets from a bankruptcy estate and from an insolvent seller.
